Welcome to Clubtek's online shop at clubtek.co.uk (the 'Site'). This Site is owned and run by Clubtek, who also process and fulfill your order. On occasion we may order items specially for you, despatched directly from our supplier. Your personal details will be held by Clubtek for the purposes of the fulfilment of your order, and may be passed to a third party if necessary for fulfilment of your order. Please read the following policies carefully before using the Site. By using the Site, you signify your agreement to be bound by these conditions.

These are the general terms and conditions of Clubtek governing your use of the Site.

1. What you are allowed to do

1.1 purchase goods from the Shop, provided you accept the Terms of Sale, which will apply to any contract made between you and Clubtek for the purchase and sale of goods from the Shop. These terms are outlined in Section 2 below;

1.2 browse the Shop using a compatible web browser. Permission to browse the Shop includes permission to make temporary or cached copies of parts of the Shop to the extent that this occurs in the normal course of using your browser and that these copies are used only to facilitate current or subsequent access to the Shop by you;

1.3 print a copy of any page of the Shop for your own personal purposes, provided you do not do any of the things set out under "What you are not allowed to do".

2. What you are not allowed to do

2.1 you may not remove or change anything on the Shop;

2.2 you are not allowed to copy or use any material from the Shop for any commercial purpose.

2.3 you are not allowed to remove or change any copyright, trade mark or other intellectual property rights notices contained in the original material or from any material copied or printed off from the Shop.

3.1 Usage of your personal information is governed by Clubtek's Privacy Policy, which forms part of these General Terms of Use.

4. Usernames and Passwords

4.1 If you want to purchase something from the Shop, we will ask you to register an account with us. During registration, you will be asked to provide your email address and password, which you can use to make a purchase;

4.2 You must keep your password(s) confidential at all times, and must not disclose the password(s) or permit anyone else to use your password(s). Any breach of any of these terms by anyone to whom you disclose the password(s) will be treated as if the breach had been committed by you, and will not relieve you of your obligations under these terms;

4.3 In the event of any failure or error in the operation of a password(s), you shall cease using the password(s) and exit the Shop immediately, and notify Clubtek of such failure or error.

5. Rights

5.1 All intellectual property rights in any material (including text, photographs and other images and sound, downloads, software, trade marks and logos) contained in these Site is either owned by Clubtek or has been licensed to Clubtek by the rights owner(s) so that Clubtek can use this material as part of the Shop. These rights are protected by United Kingdom and international copyright and database right laws. You are only allowed to use this Shop and the material they contain as set out in these terms.

6. Third party web sites

6.1 This Shop may also contain links to other third party web sites, which are not under the control of and are not maintained by Clubtek. Any such links are not an endorsement by Clubtek of any products or services available on such sites. Clubtek provides these links for your convenience only and you use such links entirely at your own risk. We accept no responsibility for the content or use of such sites or information contained in them.

7. Suspension and termination of accounts

7.1 Clubtek may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Shop from time to time. Access to or use of the Shop or pages linked to it may be interrupted or contain errors;

7.2 Clubtek may terminate your account(s) immediately in the event you breach any of these terms of use or if you are late or do not pay any sums due to Clubtek.

9. General and governing law

9.1 Clubtek may change these terms of use from time to time and will attempt to notify you of any major changes by posting a message on the Site. By browsing the Site you are accepting that you are bound by the current terms of use. Please review this policy each time you use the Site as it is subject to change at any time by Clubtek without notice to you;

9.2 This Agreement constitutes the entire agreement between Clubtek and you and takes the place of all prior agreements, representations, statements and understandings between Clubtek and you regarding the use of the Site. You agree that you have not relied upon any representation or statement not recorded in these Conditions in entering into this Agreement.

9.3 The failure of Clubtek to exercise or enforce any right or provision of this Agreement or the delay by Clubtek in so doing shall not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. The section titles in this Agreement are for convenience only and have no legal or contractual effect.

9.4 These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts in respect of any dispute arising from these terms and conditions.

II. Terms of Sale: Shop

This Terms Of Sale Policy forms part of the General Terms of Use, which governs your use of the Site, and encompasses purchasing activities on the Shop.

1. The Sales Terms

Should you purchase any goods from the Shop, you will be contracting with Clubtek on the terms outlined below. Please read these terms and conditions carefully.

1.1 These Terms of Sale ("Sales Terms") govern the supply of any goods you order via this Shop. Please read through the Sales Terms carefully. If you do not agree with the Sales Terms, do not order any goods from this Shop. If Clubtek accepts any order for goods from you, then its agreement with you will be made on these Sales Terms.

1.2 Please note that Clubtek reserves the right to amend the Sales Terms from time to time. Clubtek will publish the amended Sales Terms on the Shop and any new versions of the Sales Terms will come into effect as soon as Clubtek publish them on the Shop (with the exception that any orders that Clubtek have already accepted from you prior to any such change will be subject to the Sales Terms in force at that point).

2. Availability of the goods supplied by the Shop

2.1 Clubtek may terminate or suspend the supply of any goods displayed on the Shop in the event of out of stocks, for support or maintenance work, in order to update content or for any other reason. Clubtek may do this at any time and without notice. Products on the Shop are normally available for despatch within a business day and for products with slower availability, an estimated shipment preparation time is provided in the associated product listings on the Shop.

3. Buying goods from this Shop

3.1 Pricing policy - Clubtek may change the prices of the goods displayed on the Shop at any time. The prices for all the goods available on the Shop are clearly marked in their description and are inclusive of VAT (if applicable). All applicable delivery charges are also displayed on the Shop. All prices are in Pounds Sterling. Clubtek may make available offers and discounts using promotion codes. Only one promotion code is valid per order. PLEASE NOTE - PRICES ON OUT-OF-STOCK-ITEMS: we may be able to source more stock of an item that's currently out of stock, but the price may differ.

3.2 Conclusion of Contract of Sale - The information relating to Clubtek's goods and relevant prices are displayed on the Shop for your information and to enable you decide whether you would like to make us an offer to purchase any such goods. When you place an order to purchase a product from clubtek.co.uk, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we've dispatched that product to you. That acceptance will be complete at the time we send the dispatch confirmation e-mail to you. Any products on the same order which we have not confirmed in a dispatch confirmation e-mail to have been dispatched do not form part of that contract.

3.3 Method of payment - For orders placed via the Online Shop, Clubtek accepts online payments by credit or debit cards via Sage Pay, and from Paypal and Googlecheckout accounts, and payments by telephone during shop hours. Ownership or title to the product shall not pass to you, the buyer, until Clubtek has received payment in full.

3.4 Delivery - we offer delivery by post for smaller orders and by courier. Delivery charges cover packing, handling and delivery. Courier service requires a signature; please ensure someone will be in to sign. Courier services are available for most of the Scottish highlands and some UK islands but if you pay by Googlecheckout you need to choose the correct band yourself. We aim to despatch within a business day of placing your order. Next Day Delivery is not a guaranteed service. Adverse road conditions due to bad weather (snow, flooding etc) may affect delivery timescales. If you have not received your goods within the timescales quoted for your chosen method, please contact us via the contact page. Timescales are quoted in business days, which are Monday to Friday excluding bank holidays in England and the delivery country.

Non-delivery - please note that Royal Mail does not acknowledge failure to deliver for 15 days, so we cannot consider an item sent by post to be lost until then. Higher value, larger or heavier orders are sent by a service (courier or Royal Mail) that requires a signature, so you'll need to be at the delivery address to receive them. If you leave instructions for delivery where no signature can be taken (eg. "if no-one is in, leave in the porch"), the order will be treated as delivered when the carrier says so, whether you acknowledge receipt or not.

3.5 Out of stocks & website errors - If any item you have chosen is unavailable or there has been an error in pricing your order, Clubtek will contact you via phone or your email address and set out the options that are available to you.

3.6 Return of goods policy - We want you to be completely satisfied with your purchases. Please let us know if you are not entirely satisfied with our products or our service, so that we can rectify the situation. We try to ensure that the products are the same as our original samples, although sometimes differences do occur. Items are described and photographed as accurately as possible, but please note that sizes, colours and designs may vary. If you are not completely satisfied with any item you ordered, just return it, if possible in the original external packaging (with a copy of your receipt) within 14 days of the date of receipt and we will refund your money or send you a replacement - no questions asked. Items returned under Clubtek's returns policy must be unopened with any seals and shrink-wrap intact (e.g., for fluids, CDs and DVDs, electronics). Please note: we can only accept the return of opened items if they are faulty. We are only able to replace identical products (requests for different sizes acceptable), so if you wish to order additional items it will be treated as a new order. The Clubtek guarantee is in addition to your statutory rights. For returns under this policy, you are responsible for the cost of shipping the item back to us.

When you send your item back to us, we'll process the returned item then notify you via e-mail of your refund. You can expect a refund in the same form of payment originally used for purchase within three weeks of our receiving your return.

If you are returning an item within the first 7 days because of an error on our part or because it is damaged or defective on arrival, we'll reimburse your costs in returning it to us provided that you agree with us in advance the need to return it and the service you will be using to send it back.

3.6 b Warranty returns

Most products are covered by a one year 'back-to-base' warranty, so if they exhibit a manufacturing defect after the first 14 days, contact us. If the problem cannot be resolved remotely, we'll ask you to send the item to us and we'll either repair it or replace it. You are responsible for the cost of sending the item to us as a warranty return.

The Detail: Under warranty Clubtek will, at its option, either repair or give a replacement to you for any Goods found to be defective because of faulty maintenance by Clubtek or poor workmanship provided that
a. Clubtek is notified in writing within 7 days of your first discovering any such defects;
b. The Goods have been used in an appropriate manner and/or as prescribed in the operating instructions (if any);
c. The defective Goods are returned to Clubtek at your expense;
d. Examination by Clubtek of such Goods discloses to its satisfaction that such defect exist and have not been caused by misuse, neglect,accident, improper storage installation or handling or by repair or alteration not effected by the company;
e. The Goods not having been modified or repaired otherwise than by Clubtek or otherwise interfered with;
f. You shall pay to Clubtek the cost (as certified by Clubtek) of any examination of such Goods as a result of which Clubtek denies liability.

3.6 c Unauthorised returns

Please contact us before returning any item you believe is defective for exchange or repair. If there was no need to return the product, we may ask you to pay for us to send it back to you.

3.7 Cancellation Policy - Please note that you have a legal right to cancel your order within 14 days of the date of receipt of the goods (provided the goods are returned to us new and in an unused condition in the original packaging together with a copy of the receipt. 3.8 Legal age - clubtek.co.uk does not sell products for purchase by children. We may sell some children's products for purchase by adults. If you are under 18, you may use clubtek.co.uk only with the involvement of a parent or guardian.

3.9 Special offers - From time to time, special offers may be advertised on the website. Special offer prices quoted apply only to orders completed online.

3.10 Vouchers - From time to time, vouchers may be issued for free delivery or for discounts on orders or products. You may only use one voucher per order. Some vouchers may only be used once per customer. Please contact web2shop@clubtek.co.uk if you have any questions about redeeming a voucher code.

3.11 Free gifts - From time to time, free products may be offered with a product or order. These free products are included as part of your order and if any part of the order is returned for a refund we reserve the right to deduct the value of the free gift from your refund if they are not returned too.

1. How do we collect information?

We will obtain personal information from you when you enquire about our products or services, register with us, send or receive an email, ask for a quote, or make a purchase. Your information is only recorded in our database when you get a quote or place an order. We do not act on or record information about you from third parties, for example from a friend who wants to tell you about the website.

2. What information do we collect?

The types of information collected include names, e-mail address, postal addresses, telephone numbers. We do not record payment card details electronically in our systems. If you pay by card in our shop, the payment slip will be retained for up to 12 months in case of query and then shredded.

3. How do we use this information?

We will use your personal information to provide you with the services, products or information you have requested, for administration purposes and to process your order. We may need to share your information with our service providers, associated organisations and agents for these purposes (eg. your address, email & phone number for a delivery) and for operational reasons such as the detection and prevention of fraud. For warranty claims we may need to share your information with the product supplier.

We do not sell or rent your contact information or other data to third parties. We do not currently share your details with or send information about other companies or related products. If we decide to do this in the future, we will ask your explicit consent.

We only use your personal information for our direct marketing purposes if we have your consent. If you don't remember whether you have given consent you can ask us. You can withdraw your consent at any time; if you decide you no longer wish to receive marketing emails from us, the most efficient way is to click the unsubscribe link at the bottom of one of our marketing emails or now via this link - this records your choice in the mailing list manager and ensures you never get another marketing email to that address (if you have given us multiple email addresses, you'll need to unsubscribe each of them). We retain your personal information against an order for the period required by tax law but you can choose to delete your online account at any time; we are building an option for you to do this yourself but in the meantime please email web2shop@clubtek.co.uk.

You have the right to request a copy of the information that we hold about you. If you would lke a copy of some or all your personal information, please email or write to us at the address above. We may make a small charge for this service.

We want to make sure that your personal information is accurate and up-to-date. You may ask us to correct or remove information you think is inaccurate.

4. Do we use 'Cookies' ?

'Cookies' are small pieces of information sent by a web server to a web browser, which enables the server to collect information from the browser. Essentially it takes the form of a small text file deposited on your computer's hard drive.

Clubtek uses cookies to ensure that you can interact with our web sites successfully, to identify you when you visit our web sites and to keep track of your browsing patterns. The use of cookies does not give us access to the rest of your computer.

First party cookies - information that is stored by us and only used to interact with this site. We store session information that identifies you while making a purchase (and which will save you logging in next time you visit if this is soon). You can prevent this being stored using your browser settings and you will still be able to look at the site but the checkout will not work.

Third party cookies - information handled by other organisations which we use to analyse the usage of our website in order to improve the content and make it easier to find, and to measure the effectiveness of our promotional activities. We use facilities provided by Google and Facebook for this purpose. They do not give us any information directly attributable to you as an individual (only aggregated by various criteria).
